Terms of Service

These Terms of Service (“Terms”) govern your use of CustomSongCreator.com, owned and operated by Cloud Hosting Technologies, LLC, a Nevada limited liability company (“we,” “us,” or “our”). By placing an order, making a payment, or otherwise using our Services, you (“Customer” or “you”) agree to these Terms. Please read them carefully.


Services

We create custom songs and related media for personal and business use. Services may include:

  • Writing lyrics

  • Producing a musical composition using AI tools

  • Delivering the song via an unlisted YouTube link and/or downloadable MP3 or WAV file

  • Optional video creation and promotion (subject to additional terms or fees with your permission)

We may use subcontractors or third-party platforms (including AI providers) to fulfill parts of the Service.
We reserve the right to refuse service for requests that are offensive, unlawful, or inappropriate.


Ordering and Payment

  • Orders may be placed through our website or by responding to an invitation from us.

  • Our standard fee is $99 USD, but you may pay more or less (“pay what you want”), subject to a minimum of $20 USD.

  • Payment is due in full before delivery of the final song.

  • If you are dissatisfied with your song, you may request a full refund within 14 days of delivery, provided your request is reasonable and in good faith.


Delivery Timeline

We generally deliver songs within 2–3 business days, though delivery times are estimates only and not guaranteed. Higher-value orders may be prioritized. We are not responsible for delays caused by your failure to provide requested information or approvals.


Revisions

You may request up to two (2) reasonable revisions within 14 days of delivery. Significant or additional revisions beyond this may incur a small additional fee.


Intellectual Property & License

  • Songs are created using third-party AI platforms (including Suno). We retain ownership of the AI-generated works we produce.

  • We grant you a perpetual, worldwide, non-exclusive license to use, reproduce, perform, and distribute your custom song for personal or business purposes.

  • You may not claim copyright ownership of the song, resell it as your own original creation, or represent it as human-authored.

  • With your permission, we may showcase your song (or excerpts) in our portfolio, website, or marketing materials. You may opt out by notifying us in writing.


Customer Content

By submitting names, stories, or other material, you represent that:

  • You have the rights to provide this material and grant us permission to use it to create your song.

  • You will not submit unlawful, offensive, or infringing content.

  • We do not include last names of individuals in songs. Business names may be included.

  • You agree to indemnify and hold us harmless from any claims or damages arising out of the content you provide.


Limitations of Liability

Our services are provided “as is” without warranties of any kind. AI-generated content may not always reflect your instructions perfectly.
To the maximum extent permitted by law:

  • We disclaim all warranties, express or implied.

  • We are not liable for indirect, incidental, or consequential damages.

  • Our total liability for any claim is limited to the amount you paid us for the Service.


Privacy

We collect and use customer information in accordance with our Privacy Policy, available at:

Termination

We may suspend or terminate services if you violate these Terms or submit inappropriate content. We may also refuse future service to repeat violators.


Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules.

Any dispute shall be resolved by binding arbitration under the rules of the American Arbitration Association in Las Vegas, Nevada. Each party will bear its own legal fees unless otherwise required by law.
You waive the right to participate in class action lawsuits or class-wide arbitration.


Changes to Terms

We may update these Terms from time to time. Updates will be posted on our website with a new effective date. If you provided us your email, we may also send notice of material changes. Continued use of our Services after updates constitutes acceptance of the revised Terms.
